Terms & Conditions

By using our online store to place your order you agree to be legally bound by our terms and conditions. These terms and conditions do not affect your statutory rights as a consumer.

1 Data Protection :
1.1 Country Ways Oak is registered with the Information Commissioner's Office as a data controller we operate in strict accordance with the Data Protection Act 1998 (“The Act”).
1.2 We process your data in accordance to the Act and only use your personal details to process your order. Credit card details are processed by PayPal
1.3 As Registered Data Controllers we are committed to protecting your privacy. We use the information that we collect on our website to make shopping using our online store possible, and to include you in our Customer Care programme which is a free service giving you three years access to unlimited help and guidance in caring for your furniture bought from Country Ways Oak Furniture Makers. If you do not wish to join our Customer Care Programme you may to opt-out any time by emailing or phoning 01580 830066

2 Prices :
2.1 Prices include VAT at the prevailing rate (except private sales)
2.2 Prices displayed on our website are our on-line prices and are subject to change without notice.
2.3 We are not bound to honour any prices displayed in error. In these cases a sincere apology and a full refund will be offered, or our best alternative price.

3 Payment :
3.1 Payment for goods ordered on-line can be by: credit card, charge or debit card.
3.2 Orders can also be placed by email, post, and telephone (01580 830077), your order will be processed and a confirmation sent to you once funds are cleared. Please allow 5-7 working days for cheques to clear.

4 Product Specifications :
4.1 All the interior oak furniture displayed on our website is made from kiln dried oak and exterior from air dried oak both of which are natural materials with many variations in texture and natural colour.
4.2 Some collections are available in only one colour/finish and for other collections we offer a variety of finishes and colours to choose from, colour samples are available on request.
4.3 Oak is a natural material and may display various marks and characteristics such as knots, grain variation, colour variations etc. These are natural, and deemed by many, desirable features which demonstrate the individuality of the wood and will not affect the durability or performance of the furniture in any way. As each tree is unique, natural markings vary from tree to tree resulting in some timbers with no markings and others with some.
4.4 Oak furniture is unique, as such; dimensions, colouring and grain patterns will vary from piece to piece, with no two pieces being exactly the same.
4.5 Oak furniture is affected by heat and moisture. A hot dry environment will cause oak to shrink, whilst a damp environment will cause it to swell. Knots, cracks, drying shakes and movement are inherent characteristics of natural timber and are not considered a fault in the wood or our workmanship. Your new piece of furniture will benefit greatly by placing it in a position in a room well away from extremes of temperature, such as next to a radiator or exposed to direct sunlight
4.6 Country Ways Oak is obliged to supply quality furniture products that meet the requirements as specified and agreed with its customers and within the limits of these terms and conditions.
4.7 At no time can Country Ways Oak Furniture Makers Ltd or its staff be held responsible for the natural variances that may occur after the sale of its furniture.
4.8 In case of dispute, your statutory rights are not affected.
4.9 Country Ways Oak Furniture Makers Ltd cannot be held responsible to verbal (non-documented) requirements and therefore, we shall be under no obligation to deliver against any requirements other than those agreed and contained within the respective order form.

6 Delivery :
6.1 Country Ways Oak Furniture Makers Ltd offer a subsidised delivery service in mainland U.K.
6.2 Deliveries to other parts of the U.K and Worldwide can be arranged by us at cost.
6.3 We will endeavour to fulfill your order within the timescale usually 2-6 weeks for ready-made furniture and 4-8 weeks for handmade and bespoke oak furniture, from confirmation of order however some lead times vary depending on requirements and suppliers lead times.
6.4 All purchasers should make an allowance of up to 14 days from the date of dispatch from our premises for our approved carriers to fulfill the final delivery to your home.
6.5 You are responsible for ensuring that you have a safe means of access from the public highway to the place of delivery. If the access is deemed unsuitable by our carrier the goods will not be delivered until safe access is provided. Any extra cost incurred because of inadequate access will be payable by the customer direct to the carrier before the goods are unloaded.
6.6 Time of the delivery is not of the essence under these terms and conditions.

7 Returns and Cancellations :
7.1 You have a statutory right to return any unsuitable products within seven working days after delivery. Subject to your statutory rights this policy does not apply to bespoke furniture or furniture that has been modified or finished to your own requirements or where we have incurred a delivery charge from a supplier sourcing a product not stocked by us.
7.2 To cancel you must write, fax or email our Returns Department within those seven days. Arrange suitable delivery at your own cost and send the furniture back to us in the same condition as it was when it was delivered. Once we have received the furniture and checked its condition is satisfactory a full refund for the purchase price (less any delivery charges incurred) will be sent to you within 30 days. If the goods are damaged in any way we reserve the right to make repairs and deduct the cost from the refund payable to you.
7.3 After the seven day period has expired we are unable to accept returns of any items unless a substantial fault develops within the twelve month warranty period.

8 Damaged or incorrect goods :
8.1 If we deliver incorrect or damaged goods, or you discover a manufacturing fault needing repair or replacement, then we must be notified within seven days from receipt of the goods. This can be by telephone but we must receive written confirmation explaining the nature of the damage or manufacturing fault within the seven day period following the initial delivery of your goods. To help us make the best decision in order to rectify any possible mistake or manufacturing defect the inclusion of one or more digital photographs to accompany your correspondence should also be sent to us.
8.2 We will not be liable for any damage caused by obvious misuse or by damage incurred by you or third parties attempting any repairs without our consent.

9 Acceptance of goods :
9.1 The buyer shall be deemed to have accepted the goods seven working days after delivery.
9.2 After delivery the buyer shall not be entitled to reject the goods which are not in accordance with this contract.

10 Title and Risk :
10.1 Risk of damage to or loss of the products shall pass to the buyer upon delivery.

11 Guarantees :
11.1 We guarantee all products against faulty workmanship and/or defective materials for a minimum period of twelve months from the date of delivery.
For any faults detected after this twelve month period, please contact our customer care department on 01580 830066 for help and advice.
11.2 This guarantee does not cover: fair wear and tear, natural movement of wooden products, neglect or misuse in failing to follow our guidelines of caring for wooden furniture included with your initial purchase, accidental damage caused by you or a third party.

12 Force Majeure :
12.1 In the event that either party is prevented from fulfilling its obligations under this agreement by reason of any supervening event beyond its control, including but not limited to: any national emergency, extremes of weather including floods, strikes or lockout, disruptions of services provided by third parties including telephone and electricity providers, either party will not be deemed to be in breach of this agreement provided they take all reasonable steps to resume performance of its obligations within a reasonable time.
12.2 If and when the period of incapacity exceeds six months then this agreement shall automatically terminate unless the parties first agree otherwise in writing.

13 Third Party Rights :
13.1 A person who is not a party to the agreement shall have no rights under this agreement pursuant to the Contracts (Right of third parties) Act 1999.

14 Consumer Rights :
14.1 The provisions of these Terms and Conditions are in addition to and do not affect the buyers statutory rights as a consumer.

15 Governing Law and Jurisdiction :
15.1 The agreement shall be governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the English and Welsh courts.
